1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AI API routing service and dashboard platform provided by AetherAPI ("we," "our," or "us") at https://aetherapi.dev and our API endpoints (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AetherAPI provides an AI API routing service that forwards API requests to various AI model providers and offers a dashboard for account management and usage monitoring.

Data Handling Notice:

We do NOT store your API prompts, requests, or responses under normal operating conditions. Your data is routed directly to the selected AI model provider. We temporarily retain prompts and responses only if automatically flagged for review due to potential violations or abuse.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must:

  • Create an account with accurate and complete information.
  • Possess the legal capacity to enter into this agreement.
  • Comply with all applicable laws and regulations.

3.2 Account Security

You are responsible for the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use and Restrictions

4.1 Permitted Uses

You may use the Service to integrate AI capabilities into your applications and route API requests to appropriate AI models.

4.2 Prohibited Uses

You must not use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Generate harmful, illegal, or inappropriate content, including Child Sexual Abuse Material (CSAM).
  • Circumvent usage limits or billing mechanisms.
  • Interfere with or disrupt the operation of the Service.
  • Engage in fraudulent or abusive behavior.

You are solely responsible for all content (Input) you submit through the Service.

5. Pricing and Payment Terms

5.1 Fees and Billing

Pricing is based on API usage. All prices are specified in USD.

5.2 Payment

Payment is due immediately upon invoicing. Failure to pay may result in service suspension.

5.3 Price Changes

We reserve the right to modify prices. Continued use after price changes constitutes your acceptance of the new prices.

6. Intellectual Property

6.1 Our Rights

We retain all rights, title, and interest in the Service and its underlying technology.

6.2 Your Rights (Input and Output)

You retain all rights to the content (Input) you submit. Subject to your compliance with these Terms, we grant you a non-exclusive license to use and distribute the content generated by the Service (Output) for your lawful purposes.

7. Data Processing and Third Parties

The processing of your data is governed by our Privacy Policy. You acknowledge that requests are routed to third-party AI model providers, and each provider maintains its own terms and policies regarding data storage and usage.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA LOSS). Our total liability for any claims related to the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or show abusive behavior. You may terminate your account at any time.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Delaware, United States. Any disputes shall first be addressed through good faith negotiation.
